These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and Storiecue LLC ("we," "us," or "our"), governing your access to and use of the website at https://storiecue.com, the Storiecue mobile application, and any related services (collectively, the "Services").
By accessing or using our Services, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue use of the Services immediately.
We reserve the right to make changes to these Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms. Your continued use of the Services after any changes are posted constitutes your acceptance of the revised Terms.
Storiecue is a voice-first, trauma-informed storytelling platform that helps individuals and families capture, organize, and preserve personal stories. Our Services include:
The information provided through our Services is not intended as a substitute for professional mental health, medical, legal, or financial advice. Our trauma-informed methodology is designed to create a safe and respectful environment for storytelling, but it is not a substitute for professional mental health treatment.
You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are under 18, you may not use the Services.
You may be required to register with the Services to access certain features. You agree to keep your login credentials confidential and will be responsible for all use of your account and password. You agree that all information you provide during registration and at all other times will be true, accurate, current, and complete. We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete.
The Services may offer subscription-based access at various tiers and price points. Pricing for each tier is displayed at the time of purchase.
We may offer a free trial period of seven (7) days for new users. A valid payment method is required to begin the trial. If you do not cancel your subscription before the end of the trial period, your payment method will be automatically charged for the selected subscription plan.
Paid subscriptions are billed on a recurring basis at the interval associated with the plan you selected (monthly or annually). Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. No refunds or credits will be issued for partial billing periods.
All payment transactions are processed through Stripe. By submitting your payment information, you agree to Stripe's terms and privacy policy (https://stripe.com/privacy). We do not directly store your full credit card information on our servers.
The professional interview service is a one-time engagement priced at the rate listed on our website at the time of booking. Payment terms, scheduling details, and deliverables will be communicated at the time of purchase.
The professional interview service is not therapy, counseling, or clinical treatment. While our methodology is trauma-informed and designed with care, the service is a storytelling and documentation engagement. If a participant experiences distress during or after a session, we encourage them to seek support from a licensed mental health professional.
Once a session is scheduled, the following terms apply:
Cancellation or rescheduling requests must be submitted in writing to hello@storiecue.com.
Following the completion of your session, your final recording and any associated deliverables will be provided to you within 30 business days. Storiecue will retain a copy of your session recording for a period of 180 days after delivery to allow for any questions or technical issues. After that period, the recording will be permanently deleted from Storiecue's systems unless you have granted Storiecue specific permission to retain it for educational or training purposes as described in Section 7.
Our Services allow registered users to send storytelling prompts ("cues") to other individuals via SMS text message. By using this feature, you acknowledge and agree to the following:
Before sending a cue via SMS, you must confirm that the intended recipient has agreed to receive a text message from Storiecue on your behalf. You are responsible for obtaining this consent before sending. Storiecue is not responsible for cues sent to recipients who have not provided consent.
Recipients of SMS cues may opt out at any time by replying STOP to any Storiecue text message. Recipients may reply HELP for assistance or contact us at hello@storiecue.com. Message and data rates may apply. Message frequency varies and is determined by when a registered user chooses to send a cue.
The SMS cueing feature is intended for one-to-one, user-initiated messages tied to specific storytelling prompts. You may not use the cueing feature for bulk messaging, marketing, spam, commercial solicitation, or any automated or unsolicited communications. Misuse of the SMS feature may result in immediate suspension or termination of your account.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with third parties.
You retain ownership of all stories, recordings, text, images, audio, video, and other content you create, upload, or submit through the Services ("User Content"). Storiecue does not claim ownership of your stories.
By creating or uploading User Content on the Services, you grant Storiecue a limited, non-exclusive, royalty-free, worldwide license to store, process, display, reproduce, and transmit your User Content solely as necessary to operate, provide, and improve the Services. This license exists only for as long as your User Content remains on the Services.
The Services may use artificial intelligence to transcribe, organize, or transform your User Content into derivative works (such as letters, summaries, speeches, or other formats) at your direction. You retain ownership of AI-generated assets created from your User Content.
The Services, including their design, features, branding, name, logo, cue methodology, interview methodology, and all content created by Storiecue (excluding User Content), are the property of Storiecue LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any Storiecue materials without our prior written permission.
You are solely responsible for your User Content. You represent and warrant that you have the necessary rights to share any content you upload, that your content does not violate any law or infringe upon the rights of any third party, and that you have obtained consent from any individuals whose stories or personal information are included in your User Content.
Our Services include features powered by artificial intelligence, machine learning, or similar technologies. These features are designed to help you organize, transcribe, and transform your stories. AI-generated outputs are based on the content you provide and may not always be perfectly accurate. You should review all AI-generated content before using or sharing it.
Our use of AI service providers is described in our Privacy Policy. By using AI features, you agree not to use them in any way that violates these Terms or the terms of our AI service providers.
You may not use the Services for any purpose that is unlawful or prohibited by these Terms. You agree not to:
The Services may contain links to or integrate with third-party websites, services, or applications (including payment processors, SMS providers, and AI service providers). We are not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with third-party services are governed by their respective terms and policies.
We reserve the right, but not the obligation, to: (a) monitor the Services for violations of these Terms; (b) take appropriate legal action against anyone who violates the law or these Terms; (c) refuse, restrict access to, limit the availability of, or disable any User Content or any portion thereof; (d) remove from the Services or otherwise disable files and content that are excessive in size or burdensome to our systems; and (e) manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.
We care about data privacy and security. Please review our Privacy Policy at https://storiecueprivacy.netlify.app/. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Terms.
These Terms remain in effect while you use the Services. We may suspend or terminate your account and access to the Services at our sole discretion, without notice or liability, for any reason, including if we determine that you have violated any provision of these Terms.
Upon termination of your account, your right to use the Services will immediately cease. Storiecue will retain your User Content for thirty (30) days following termination to allow for data retrieval, after which it may be permanently deleted.
All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, STORIECUE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. STORIECUE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THE SERVICES AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL STORIECUE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF CONTENT, LOSS OF REVENUE, OR EMOTIONAL DISTRESS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
STORIECUE'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO STORIECUE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless Storiecue LLC, its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Bexar County, Texas, and you hereby consent to the personal jurisdiction of such courts.
